Acceptance and Scope of the General Terms and Conditions of Sale

These General Terms and Conditions of Sale apply to any purchase made by any non-professional buyer (hereinafter referred to as the "Customer" or "Buyer") from ETHNOPLANTS, whose registered office is located at 118 impasse des Chardonnerets, 74460 MARNAZ, France, registered with the RCS of Annecy under SIREN number 494 845 019 (hereinafter referred to as the "Seller"), via the online store: https://www.ethnoplants.com/

By placing an order on the ETHNOPLANTS website, you declare that you are 18 years of age or older.

You accept full responsibility for the legal status of the products shipped to you.

Accordingly, placing an order constitutes full and unconditional acceptance of these Terms and Conditions of Sale by the Buyer.

These Terms and Conditions govern ETHNOPLANTS’s distance selling activity.

Any order placed on the Website implies full and unconditional acceptance of these Terms and Conditions of Sale by the Buyer.

ETHNOPLANTS reserves the right to modify these Terms and Conditions at any time. The applicable Terms and Conditions are those in effect at the time the order is placed.



Orders

The Buyer agrees to check the applicable laws and customs regulations in their country before placing an order.

ETHNOPLANTS cannot be held liable for any use made of its products.

This website should not be shown or distributed in any country where doing so is considered a legal offense.

ETHNOPLANTS is an e-commerce site; orders can only be placed via the Website.

To place an order, the Customer must follow the steps indicated on the Website. If the Customer does not already have an account, they must create one.

The information provided by the Customer during the order process is binding.

In the event of an error, incomplete or inaccurate address details, ETHNOPLANTS disclaims any responsibility for non-delivery or delivery delays.

A paper invoice is included with the shipment.

For any request to modify or cancel an order before shipment, the Customer must contact ETHNOPLANTS by email only. If the order has already been shipped, the Seller reserves the right to refuse any modification.



Prices

All prices are listed in euros, including taxes (TTC) and are payable in euros only.

ETHNOPLANTS may offer promotional discounts, which will be available for limited periods and stock quantities.

Product prices do not include shipping fees; these are communicated to the Customer before order confirmation.

Shipping and packaging fees vary depending on destination, product type, and quantity.

€3.45 to €19 for international deliveries.

Payment Methods

Accepted payment methods are: credit card and bank transfer.

Bank Transfer : 

The order will be confirmed and processed only after full payment has been received. A confirmation email will be sent to the address provided by the Customer.

ETHNOPLANTS advises customers to check their spam/junk folder in case they do not receive the confirmation.

Credit Card : 

The Seller informs the Customer that all card transactions are secured via 3D Secure authentication.
The Customer must provide their card number, CVV code, and expiration date.

The Seller does not store any banking information.



Availability

In case of product unavailability after an order is placed, the Customer may request a replacement with a similar product of equivalent value.

If no replacement is desired or possible, the Customer will be refunded for the unavailable item as soon as possible.



Right of Withdrawal

In accordance with Article L121-21 of the French Consumer Code, the Customer has a 14-day period from the date of delivery to exercise their right of withdrawal without justification.

This right only applies to seeds and not to live plants, which are considered perishable goods.

To exercise this right, the Customer must complete the withdrawal form available on the Website, or provide a written request before the deadline.

The Customer must return the products at their own expense, in the original packaging, along with the withdrawal form.

The refund will be issued within 14 days of receiving the returned item.



Shipping and Delivery

Orders are shipped every Monday and Wednesday.

Delivery of cold-sensitive or climate-sensitive plants may be postponed at the Seller’s discretion.

The Buyer will be notified of the shipment via email to the address provided when placing the order.

Plants and seeds are shipped in padded envelopes. Plants are first placed in rigid and airtight plastic containers, ensuring safe transport. The root system is enclosed in a small recycled plastic bag.

Plants are generally between 10 and 20 cm in height, with a well-developed root system for optimal growth.

The size indicated on the product pages is for reference only and may vary due to natural growth variation. ETHNOPLANTS will provide the closest size available at the time of shipment.

The Seller recommends that the Buyer : repot the plants immediately upon receipt, water thoroughly at planting, avoid using fertilizer initially and adapt the substrate to the plant species

Orders are shipped via La Poste (French postal service). Transit times are estimated between 2 to 10 business days. If this timeframe is exceeded, the Buyer is encouraged to contact their local post office.

Delivery times are not guaranteed and delays do not entitle the Customer to compensation from ETHNOPLANTS.

The Buyer acknowledges that no tracking number is provided for orders under €50 (shipping included).

The Customer is solely responsible for the information entered during the order process.

In case of an incorrect or incomplete delivery address, the parcel may be returned to ETHNOPLANTS or held by the local carrier according to their policies.

If reshipment is necessary, the Customer will bear the cost, and must contact ETHNOPLANTS in advance to arrange payment.


Warranty

All plants and seeds are shipped in excellent health and with good germination potential.

However, the success of germination or plant establishment depends largely on the methods used by the Buyer (stratification, scarification, soaking, soil type, moisture, temperature, etc.).

Therefore, ETHNOPLANTS cannot guarantee germination or successful plant growth.

If plants arrive in poor condition, the Customer must send photos by email or MMS so that we can assist with recovery or provide after-sales support.

Claims

Any customer complaints must be addressed to the Seller by phone at +33 (0)7 86 80 78 00 or via the contact form on the Website.

Liability

The products offered comply with French regulations.

For deliveries outside of France, it is the Buyer's responsibility to ensure compliance with their local laws.

All product descriptions and cultivation guides are provided for informational purposes only.

The Seller shall not be held responsible for any results or consequences resulting from the misuse of the seeds or plants sold.

For any medicinal use, Customers are advised to seek the opinion of a qualified medical professional.

ETHNOPLANTS declares that the products sold are not intended to treat, cure, or prevent any disease or medical condition.

Mediation

In accordance with Articles L611-1 to L616-3 of the French Consumer Code, all Customers have the right to use mediation services free of charge in order to seek an amicable resolution to a dispute with the Seller.
